Announcement on environmental risk control requirements for five types of persistent organic pollutants, including polychlorinated naphthalenes
On December 30, 2022, the Standing Committee of the Thirteenth National People's Congress considered and approved the Amendment to the Stockholm Convention on Persistent Organic Pollutants to Include Three Types of Persistent Organic Pollutants, Including Polychlorinated Naphthalenes, and the Amendment to the Stockholm Convention on Persistent Organic Pollutants to Include Three Types of Persistent Organic Pollutants, Including Short-Chained Chlorinated Paraffins (hereinafter collectively referred to as the Amendments). The Amendments entered into force on June 6, 2023 for our country.
The Amendment provides for the phase-out or restriction of five POPs, namely, hexachlorobutadiene (HCBD), polychlorinated naphthalenes (PCN), pentachlorophenol (PCP) and its salts and esters, decabromodiphenyl ether (DecaBDE) and short-chained chlorinated paraffins (SCCPs). Taking into account the relevant management regulations in China, the following announcement is made on the restriction and control of the above five types of persistent organic pollutants:
一、The production, use, import and export of hexachlorobutadiene, polychlorinated naphthalenes (PCNs), pentachlorophenol (PCP) and its salts and esters are prohibited.
二、Prohibit the production, use, import and export of decabromodiphenyl ether (except for the following uses).
(一) Textile products that need to have flame retardant characteristics (excluding clothing and toys);
(二) Additives in plastic casings and components used in household heating appliances, irons, fans, immersion heaters that contain or are in direct contact with electrical parts, or are required to comply with flame retardant standards, with a density of less than 10% by weight of the part;
(三) Polyurethane foam for building insulation;
The exemption period for the above three categories of use is until December 31, 2023
三、Prohibit the production, use, import and export of short-chained chlorinated paraffins (except for the following uses).
(一)Additives used in the production of conveyor belts in the natural and synthetic rubber industry;
(二) Spare parts for rubber conveyor belts used in the mining and forestry industries;
(三)Leather industry, in particular for greasing leather;
(四)Lubricant additives, in particular for the engines of automobiles, generators and wind energy installations, as well as for oil and gas exploration drilling and refineries for the production of diesel fuel;
(五) Outdoor decorative lamps;
(六) Waterproof and flame retardant paints;
(七) Adhesives;
(八) Metal fabrication;
(九) Secondary plasticizers for flexible polyvinyl chloride (but not for processing use in toys and children's products);
The exemptions for the above nine categories of uses expire on December 31, 2023
四、Enterprises, institutions and other producers and operators emitting HCBD and PCN shall take effective measures to effectively reduce emissions or eliminate the emission sources. The development and application of alternative technologies are encouraged to prevent the generation and emission of HCBD and PCN.
五、Unless otherwise specified, chemical substances used for laboratory scale research or used as reference standards, and chemical substances appearing as unintentional trace pollutants in products and articles shall not be applied to the above requirements on prohibition or restriction of production, use, import and export.
六、the departments of ecology and environment, industry and information technology, housing and urban-rural construction, agriculture and rural areas, commerce, emergency management, market supervision and management, disease prevention and control, as well as the Customs at all levels, shall, in accordance with the provisions of the relevant national laws and regulations, strengthen the supervision and management of the production, use, import and export of the above five types of persistent organic pollutants. Once any violation of the announcement is found, it shall be seriously investigated and dealt with in accordance with the law.
七、This announcement shall come into force from June 6, 2023 onwards.
